Dear Ms.Drube:
I appreciate your response this morning to my earlier inquiry as to the inordinate delay in getting the liens filed with the Bay County Clerk of Courts.
Clearly there are 3 possibilities which may have come into play here:
1) Ms. Dobbins did not sent the items back to you,
2) They were lost in the mail,
3) Your office mislaid/lost them
1) I discount #1 as Ms. Dobbins was very clear a month ago when I was in her office and I specifically asked her about the status of the liens, and she told me then that she had signed and returned them, this isn't just some story she came up with now that they have gone missing,
2) Mail at the complex frequently gets returned by the carrier or not forwarded at all. I once had my homeowners insurance canceled because I did not get the notice(s) to renew. However, the mail problems are with incoming mail, I am totally unaware of any problem with outgoing mail, I have not had any such problems and have not heard any complaints about 'outgoing' mail,
3) The reason I noticed the missing filings is rather basic, the last set of filings took an extensive amount of time to be filed and when this was again happening, I complained several times to Ms. Dobbins and finally contacted your office directly, and only then was it discovered that your office could not locate the forms we had returned.
I can only speak for myself in this matter, but based on your firms prior very tardy filings of liens, I believe that the problem is in your office and not with either the office here at Nautilus Cove or with the post office.
I do appreciate your time and effort in contacting me and I understand fully that I have no real 'standing' in this matter and a reply to me was not necessary. I have for several months, since the late filings of the last liens, been suggesting to our management company that we stop using your firm for legal work.
Whether or not we now change firms is not up to me, however, in late July our Association will elect the 2nd BOD member and thus be under control of the actual owners here at the complex. I would opine that if we haven't changed legal firms before that date, then we will be changing in August.
Again, thank you for your reply in this matter and I hope that these filings can now be made expeditiously.

Dear Mr. Harris,
I am not certain as to the exact liens that you are inquiring about, however, the last liens that were sent to us to prepare in December were prepared and returned promptly to your CAM for signature on January 6, 2010. When we receive signed liens back in the mail, it is our policy to immediately file them with the clerk of court. We have spoken with your CAM, and it appears that she attempted to mail the liens back to us but for some reason they never reached our offices. Your CAM said that you have been having problems with a new mail carrier, I can only think that they must have been lost in the mail. Regardless, we have updated the liens prepared in January and resent to your CAM. As soon as we receive the signed liens back, we will send them to the Bay County Clerk of Court to be filed.
Please be assured that it is our policy to promptly prepare and file all liens sent to our offices, and that this delay is an unusual occurrence that was not the fault of our staff.

Subject: Delay in Lien filings for Nautilus Cove Condo
Dear Ms Drube:
I am an owner of a condo unit at Nautilus Cove in PCB.
We have turned over to you various paperwork so as to file liens on a number of condos. Our CAM told me that this was sent to your office on Dec. 18th, that the paperwork was subsequently returned to her for signature and then sent back to your office.
As of this morning I do not see any recent lien filings in the Bay County Court on our behalf.
I have inquired at our office at least 3 times about this delay and understand that our CAM was to contact you by phone to inquire about the delay.
We are now at a bit over 2 1/2 months in getting these simple liens filed and as an owner at NCC who has an interest in getting our liens filed in a prompt and workman like manner I am now asking you if there has been some problem encountered with getting this matter taken care of and if not then why has such a simple matter taken so long to file?
May I now have your assurance that these liens will be filed this week?
